Terms & Liability Waiver

1 Assumption of Risk

Participation at SwingDen involves inherent risks, including but not limited to:

• Golf club swings in a confined space
• Ball mis-hits, ricochets, or rebound from simulator screens or walls
• Accidental contact with other participants or objects
• Slips, trips, and falls (including those involving food or beverages)
• Equipment malfunction or misuse
• Actions of other participants

By participating, you voluntarily assume all risks, whether known or unknown.

2 Release of Liability (Including Negligence)

To the fullest extent permitted by the laws of the Commonwealth of Virginia, you hereby:

• Release and discharge SwingDen, its owners, employees, and affiliates
• From any and all claims, liabilities, damages, or causes of action

This does not apply where prohibited by law (e.g., gross negligence or willful misconduct).

3 Alcohol Responsibility

If alcohol is consumed on the premises:

• You acknowledge that alcohol impairs judgment, coordination, and reaction time
• You assume full responsibility for your actions
• You agree not to operate a vehicle while impaired

You further agree that SwingDen is not responsible for any injury, damage, or incident resulting from your alcohol consumption.

SwingDen reserves the right to refuse service, limit alcohol consumption, or remove any guest at its sole discretion.

4 Indemnification

You agree to indemnify and hold harmless SwingDen from any claims, damages, losses, or legal expenses (including attorney's fees) arising from:

• Your actions or negligence
• Injury to yourself or others
• Damage to property
• Any violation of these terms

5 Code of Conduct

All participants agree to:

• Follow all posted rules and staff instructions
• Maintain safe distances when others are swinging
• Use equipment properly
• Act in a respectful and responsible manner

SwingDen reserves the right to remove any individual for unsafe, disruptive, or inappropriate behavior.

6 Minor Participation

If signing on behalf of a minor:

• You confirm you are the parent or legal guardian
• You agree to all terms on behalf of the minor
• You assume full responsibility for the minor's supervision and conduct
• You waive any claims on behalf of both yourself and the minor

7 Photo & Media Release

By entering SwingDen, you grant permission for SwingDen to capture photos and videos, and use such content for marketing, promotional, and advertising purposes. No compensation will be provided.

If you prefer not to appear in media, please notify staff in advance.

8 Governing Law

These Terms shall be governed by and interpreted under the laws of the Commonwealth of Virginia.
